Terms of Service

These terms apply to MarkPlan Pro (the "app") and this website, provided by JN ("we", "us"). By starting a trial, subscribing or using the app you agree to them on behalf of yourself and, if you sign up for a company, that company.
1. Accounts
- Each account is for one named person. Do not share sign-in details.
- Each user may be signed in on up to 2 devices at a time. Signing in on another device signs out the device used least recently.
- You are responsible for activity under your accounts and for keeping passwords safe. Tell us promptly if you think an account has been misused.
2. Free trial
A free trial lasts 14 days, includes all features and covers up to 2 users. We may decline or end a trial at our discretion. When a trial ends without a paid plan, the app becomes read-only (see section 6).
3. Plans and payment
- Prices are shown on our website in Hong Kong dollars. The Team plan requires at least 3 users; Firm pricing for 10 or more users is agreed in writing.
- Fees are payable in advance for each monthly or yearly period, as stated on your invoice.
- Subscriptions renew for the same period unless you tell us before the renewal date that you wish to cancel. Cancellation takes effect at the end of the period already paid for.
- Fees already paid are not refundable for partial periods, except where the law requires otherwise.
- We may change prices for future periods by giving you at least 30 days' notice.
4. Your licence to use the app
While your trial or subscription is active, we grant you a non-exclusive, non-transferable right to use the app for your own business. You must not copy, resell, reverse-engineer or modify the app, remove copyright notices, or try to bypass sign-in, licence or device limits.
5. Your projects and data
- Projects, plans and markings are stored on your own device, not on our servers. You own your content.
- Because we do not hold a copy, you are responsible for backing up your work, for example by exporting the project file regularly. Deleting the app or website data, resetting or losing a device can permanently delete projects we cannot recover.
- You must have the right to use any plans or documents you import.
6. When a subscription ends
If your trial or subscription ends or is suspended, the app becomes read-only. You can still open and export your existing projects, but cannot create or change markings until you renew.
7. Professional responsibility
MarkPlan Pro is a drafting and recording tool. It is not affiliated with or endorsed by the Buildings Department. Defect categories and report layouts follow the MBIS / MWIS Code of Practice for convenience only. You are solely responsible for your inspections, findings, the content of any report and its compliance with legal and professional requirements. Check every export before you submit it.
8. Updates and availability
We may update the app to fix problems or add or change features. The app needs an occasional internet connection to confirm your subscription and receive updates. We aim to keep the service available but do not guarantee it will be uninterrupted or error-free.
9. Disclaimer and limitation of liability
To the extent permitted by law, the app is provided "as is" without warranties of any kind. We are not liable for any indirect or consequential loss, loss of data, profit or business, or for decisions made using the app. Our total liability for any claim is limited to the fees you paid us in the 12 months before the claim. Nothing in these terms limits liability that cannot be limited by law.
10. Suspension and termination
We may suspend or end your access if you do not pay, breach these terms, or use the app unlawfully. You may stop using the app at any time.
11. Changes to these terms
We may update these terms. We will post the new version on this page and, for material changes, tell account owners in advance. Continuing to use the app after a change means you accept it.
12. Governing law
These terms are governed by the laws of the Hong Kong Special Administrative Region, and the courts of Hong Kong have exclusive jurisdiction.
